Terms of Service

This Terms of Service Agreement ("Agreement") governs your use of our services and products, provided by TechInSF ("Company", "we", "us", "our"). By accessing our services, you agree to be bound by the terms and conditions set forth in this Agreement. If you do not agree with any of these terms, you are prohibited from using or accessing our services.

1. Services Rendered
You acknowledge by making any payments towards services that the services have been rendered to your satisfaction. We strive to provide quality services and products as described in our service descriptions. All service charges are final and non-refundable once purchased. All part purchases are final and non-refundable outside of a 30-day warranty, subject to approval.

2. Fees and Waivers

  • Processing Fees: All labor includes a 3% processing fee covering administrative costs and payment processing.
  • Late Payment Fees: Invoices outstanding for more than 15 days are subject to a $50 late payment fee.
  • Restocking Fee: Items returned may be subject to a 20% restocking fee.
  • Travel Fees: On-site visits may require travel fees depending on location, which will be charged at typical on-site rates covering time spent traveling 1-way from San Francisco. In situations that require parking fees that exceed nominal thresholds, a fee may also be necessary to accommodate on-site consultants. Potential fees will be discussed prior to appointment scheduling but may be added later depending on circumstances.
  • Cancellation Fees: In any situation where an appointment is canceled with less than 4 hours' notice, a 1-hour fee may be imposed at the standard on-site rate to accommodate consultant time and scheduling availability. In any situation where an appointment is not canceled but is determined to be a “no-show” from the customer, the full minimum (1 hour for remote, 2 hours for on-site) at the standard rate will be billed.
  • Site Walk Waiver: For initial consultations or “site walks” conducted to produce quotes or plans of service, our 2-hour minimum for on-sites may be waived to 1 hour. This waiver is only applicable in the event a project moves forward. In the event a project is canceled or not approved, TechInSF Consulting reserves the right to bill for a standard 2-hour minimum to properly compensate for consultant time in developing plans of action.

3. Dispute Resolution
To dispute a charge or service, contact our customer service at billing@techinsf.com to seek a resolution prior to initiating any disputes/chargebacks. Initiating a chargeback without prior communication will be considered a breach of this Agreement. We reserve the right to use all appropriate documentation to contest chargebacks. We also reserve the right to charge any and all applicable time contesting a chargeback as a service fee of standard consulting time.

4. Warranty
All parts include a 30-day warranty in combination with the manufacturer’s warranty, covering defects in material or workmanship under normal use.

5. Legal Compliance
Customers agree to comply with all local, state, federal, and international laws while using our services.

6. Limitation of Liability
Our company shall not be liable for any indirect, special, incidental, or consequential damages arising from the use of our services, including, but not limited to, lost profits.

7. Indemnification
You agree to indemnify, defend, and hold harmless our company, its officers, directors, employees, agents, licensors, suppliers, and any third-party information providers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of this Agreement or any activity related to your account (including negligent or wrongful conduct).

8. Amendments
We reserve the right to amend these terms and conditions at any time. All amendments to these terms will be posted on our website.

9. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of California without regard to its conflict of law principles.
